A brief on your rights as a New York employee:

The New York labor laws can get a little murky when it comes to termination. Because this state does not make it a “right to work” state, you can legally be fired for no reason at all.

Most states, including New York, leaves employment “at-will,” allowing your employer to fire you for arbitrary reasons. That’s why wrongful termination can get a little confusing. However, there are two reasons an employer cannot fire a worker:

  1. Employers cannot discriminate against anyone based on sex or gender, sexual orientation, age, race, pregnancy status, national origin, disability or perceived disability, or marital status
  2. With an employment contract that is written or implied, that you and your employer agree you will not be fired without just cause for an outlined period. The terms of the contract typically detail the reasons for which you can be fired.
